Retrofit Design Limited – Terms & Conditions

  1. Introduction

1.1 These Terms & Conditions (“Terms”) govern your use of our website www.retrofitdesign.ie, and any services offered by Retrofit Design Limited, including the purchase of goods and services made through our online payment system (via BOIPA or other payment providers).

1.2 By using the website, registering an account, or making an order, you agree to be bound by these Terms.

1.3 We reserve the right to revise these Terms from time to time; the version published on the website at the time of order applies.

  1. Definitions

– “Consumer” means an individual acting for purposes outside his/her trade, business, craft or profession.

– “Goods / Products” means the items we offer for sale through our website.

– “Services” means any non‑physical services offered (if applicable).

– “Order” means a confirmed order placed by you via our website.

– “Payment Provider” means BOIPA or any third-party handling payments.

  1. Orders, Acceptance & Contract Formation

3.1 All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order (for example, due to stock unavailability, pricing error, or suspicion of fraud).

3.2 A contract is formed when we send you an order confirmation email (or payment confirmation) indicating acceptance of your Order.

3.3 We may require you to provide identity or address proof before accepting an Order.

  1. Prices & Payment

4.1 All prices are quoted in [EUR], inclusive of VAT (if applicable), unless otherwise stated.

4.2 Payment must be made via the payment methods offered (e.g. via BOIPA).

4.3 You must pay in full prior to dispatch (unless otherwise agreed).

4.4 If payment is declined by the payment provider, we will not be obliged to fulfil your Order.

 

  1. Delivery / Shipping

5.1 We deliver goods to the delivery address you specify at the time of order.

5.2 Delivery times stated are estimates only; delays may occur.

5.3 Risk in the goods passes to you upon delivery.

5.4 Title (ownership) of goods passes to you only once full payment (including all costs) has been received.

  1. Cancellation, Returns & Refunds

6.1 You may have a right to cancel under Irish / EU consumer law (see Cancellation Policy).

6.2 Other return/refund rights (for faulty goods, etc.) are governed by statutory rights (e.g. Sale of Goods Act / Consumer Rights) and as set out in our Cancellation Policy.

6.3 Refunds will typically be processed via the original payment method.

  1. Your Obligations

7.1 You warrant that all information you provide (name, address, payment details) is accurate and up to date.

7.2 You must notify us immediately of any unauthorized use of your account or payment details.

  1. Liability, Disclaimers & Indemnity

8.1 To the fullest extent permitted by law, our liability is limited to the purchase price paid by you.

8.2 We do not exclude liability for death or personal injury caused by our negligence, or for fraud or other liability that cannot be excluded by law.

8.3 You agree to indemnify us against any losses, damages, costs, or expenses arising from your breach of these Terms.

  1. Intellectual Property

9.1 All content on the website (text, graphics, logos, images, software) is our property or licensed to us.

9.2 You may not copy, reproduce or exploit any part of the website without our prior written consent.

  1. Force Majeure

We are not liable for failure to perform our obligations due to causes beyond our reasonable control (e.g. natural disasters, strikes, acts of government, network failures).

  1. Governing Law & Jurisdiction

These Terms are governed by Irish law. Any disputes shall be subject to the non‑exclusive jurisdiction of the Irish courts.

  1. Miscellaneous

If any provision is found invalid or unenforceable, that provision will be severed and the remainder will continue in full force.

These Terms constitute the entire agreement between you and us regarding your use of our services and supersede any prior agreements.
